In consideration of being permitted to enter and participate in activities at 5019414 Ontario Inc. o/a THE FUNNERY PLAY PARK & CAFÉ (the "FUNNERY"), located at 611 Steven Court, Unit 3, Newmarket, Ontario, I agree to the following:
I understand that participation in activities at an indoor playground involves inherent risks, including but not limited to slips, falls, collisions, and equipment-related injuries. These risks may result in personal injury, illness, disability, or death. I voluntarily assume all risks, whether known or unknown, for myself and any child(ren) under my care.
I hereby release and forever discharge the FUNNERY, including its owners, directors, officers, employees, volunteers, contractors, agents, affiliates, successors and assigns (the Released Parties) from any and all claims, demands, actions, causes of action, damages, or liability of any kind arising from or related to my or my child's participation in activities at the FUNNERY, including those arising from the negligence of the Released Parties.
I agree that neither I, nor any person acting on my behalf (including family members, heirs, guardians, or representatives), will commence or maintain any legal action against the Released Parties for any injury, illness, death, loss, or damage arising from participation at the FUNNERY.
I understand and agree that I am solely responsible for supervising my child(ren) at all times while at the FUNNERY. I must follow all posted rules and staff instructions. The FUNNERY is not responsible for any lost, stolen, or damaged personal property.
By signing this agreement, I confirm that I am the parent or legal guardian of the child(ren) participating, and I am authorized to sign this waiver on their behalf. This agreement is binding on me and the child(ren).
This agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario.
If any part of this agreement is found to be invalid or unenforceable, the rest of the agreement will still remain in full force and effect.
I confirm that I have read and understand this waiver and release of liability. I am signing it freely and voluntarily and understand that by signing it, I am giving up legal rights on behalf of myself and my child(ren).
